3. Definition of Legal Guardian

For purposes of this agreement, a “legal guardian” is a person who has legal responsibility for the care and decision-making of the minor participant, including a biological parent, adoptive parent, or a person appointed as guardian by a court of law. By signing below, you represent that you are legally authorized to sign this agreement on behalf of the child.

4. Assumption of Risk

I understand that participation in a youth duathlon, triathlon, or tri-relay involves inherent risks, including but not limited to:

Falls and collisions with other participants or objects
Road crossings and interaction with traffic
Uneven pavement or terrain
Weather conditions (heat, cold, rain, wind)
Equipment failure (including bicycles and helmets)
Swimming-related risks during triathlon events

I understand that helmets are required, bicycles are used, water activities may be involved, and that although volunteers will assist with traffic control and medical staff will be present, not all risks can be eliminated.

I knowingly and voluntarily assume all risks, both known and unknown, associated with my child’s participation.

5. Release and Waiver of Liability

To the fullest extent permitted by South Dakota law, I, on behalf of myself and my child, release and waive all claims against:

Black Hills Youth Races, Inc.
Its officers, directors, employees, volunteers, contractors, and agents
Event sponsors and partners
The City of Spearfish and any governmental entities involved
USA Triathlon and related sanctioning bodies

from any and all claims arising out of ordinary negligence related to participation in this event, including injury, illness, death, or property damage.

This release does not apply to gross negligence or intentional misconduct.

6. Indemnification

I agree to indemnify and hold harmless the released parties from any claims, damages, or expenses (including attorney’s fees) arising from my child’s actions or participation in the event.

7. Medical Treatment Authorization

I authorize Black Hills Youth Races, Inc. and event medical personnel to provide emergency medical treatment to my child if I cannot be reached. I understand that I am financially responsible for any medical care provided.

8. Photo and Video Release

I grant permission for Black Hills Youth Races, Inc. to use photographs, video recordings, or other media of my child taken during the event for promotional, educational, or informational purposes, without compensation.

9. Code of Conduct & Removal

I understand that the event organizers reserve the right to remove any participant whose behavior is unsafe, unsportsmanlike, or disruptive, without refund.

10. Governing Law

This agreement shall be governed by and interpreted under the laws of the State of South Dakota.

11. Acknowledgment and Signature

I have read this agreement carefully, understand its contents, and sign it voluntarily.
